Terms and Conditions

Welcome to The Cosmic Connect! These Terms and Conditions (“Terms”) form a legally binding agreement between you (the “User” or “you”) and Cosmic Connect India LLP, doing business as The Cosmic Connect (referred to as “TCC”, the “Company”, “we”, or “us”). By accessing our website (https://www.thecosmicconnect.com or https://www.thecosmicconnect.in) or purchasing any product or service from us (including digital downloads, physical goods, online/offline services, courses, or memberships), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using our site or services.

 

We strive to uphold high standards of expertise, experience, authoritativeness, and trustworthiness (EEAT) in all our offerings. Please read these Terms carefully to understand your rights and obligations. If you have any questions, contact us at info@thecosmicconnect.com.

 

1. Scope of Services

The Cosmic Connect offers a range of spiritual wellness products and services both online and offline. Our offerings include, but are not limited to:

  • Physical Products: Semi-precious crystal jewelry, healing crystals, spiritual tools (e.g. sage, incense, bracelets), and other wellness merchandise, which may be sold via our website or integrated third-party platforms.

  • Digital Products: E-books, guided meditation audio/video, and other digital content available for download or streaming.

  • Services (Online & Offline): Metaphysical and healing services such as Reiki healing sessions, Tarot card readings, Akashic Records readings, Mokshapat readings, Aura scanning, Past Life Regression therapy, Crystal therapy, meditation sessions, and related consultations. These may be delivered online (via phone, video call, or email) or offline (in-person at our Delhi center or other locations for workshops/events).

  • Educational Courses: Live or pre-recorded courses in areas like Reiki Healing, Tarot Reading, Pendulum Dowsing, etc., including certification courses. (Certificates acknowledge completion but do not confer any government-recognised qualification or license.)

  • Subscriptions/Memberships: Subscription plans or memberships that provide ongoing access to exclusive content, community forums, periodic healing sessions or readings, discounts on services, or other benefits as described for each plan.

 

These Terms apply to all of the above offerings. Additional specific terms may be presented for certain courses or programs, and in the event of a conflict, those specific terms will govern that service. All Users must also comply with any guidelines or rules posted for particular services.

 

2. Eligibility and User Representation

  • Legal Age: You must be at least 18 years old (the age of legal majority in India) to purchase or use our services/products. By using The Cosmic Connect, you represent that you are 18 or older. If you are under 18, you may use our services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. We do not knowingly contract with minors contrary to the Indian Contract Act, 1872.

  • Competence: You affirm that you are legally capable of entering into a contract. If you are registering on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

  • Truthful Information: You agree to provide true, current, and complete information about yourself as required for any account registration, purchase, or booking. Using a false identity or information is prohibited.

  • One Account: You agree to maintain only one account in your name for services requiring an account. You are responsible for keeping your login credentials confidential and for all activities under your account. Notify us immediately of any unauthorised use. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

 

We reserve the right to refuse service, cancel accounts, or block access at our discretion if we believe a user is violating eligibility requirements or any portion of these Terms.

 

3. User Responsibilities and Conduct

When engaging with our site or services, you agree to conduct yourself in a respectful and lawful manner. To ensure a positive, safe experience for all, you agree NOT to:

  • Engage in Abusive Behaviour: You will communicate respectfully with our staff and other users. Any form of harassment, hate speech, intimidation, or abuse (in messages, calls, sessions, or community forums) is strictly prohibited. We expect punctuality and cooperation during scheduled sessions. If you are more than a brief period late to an appointment without notice, or if you behave inappropriately, we reserve the right to shorten or cancel the session (with applicable cancellation fees as stated).

  • Misuse the Services or Content: You will not use our site or services for any fraudulent or illegal purpose. You will not attempt to hack, mine data, introduce viruses, or disrupt the functionality of our website. You will not use automated scripts or scrapers to collect information from our site without permission.

  • Infringe Intellectual Property: You will not copy, reproduce, distribute, or create derivative works from our content (courses, videos, text, logos, etc.) except as allowed under these Terms (see Intellectual Property section). This includes not recording paid sessions or sharing course materials with non-paying individuals without authorisation.

  • Impersonation or False Statements: You will not impersonate any person or entity, or falsely state or misrepresent yourself (for example, you will not falsely claim to be a certified healer due to taking our course or misrepresent the results of a service).

  • Reselling or Unauthorised Use: You will not resell our products or services to others without our express written consent. (For instance, you cannot buy our courses or memberships and then share or resell access to others.)

 

Violation of the above or any other provision of these Terms may result in immediate termination of your account or services, with or without notice, and potential legal action if warranted. We reserve the right to refuse or discontinue service to anyone we determine is violating these Terms or engaging in misconduct.

4. Orders of Products (Physical and Digital)

4.1 Placing Orders:

When you place an order for a product (physical merchandise or digital download) through our website or authorised platform, you are making an offer to purchase the item in accordance with these Terms. After you submit an order and payment, we will send an order confirmation via email or on-screen. This confirmation signifies our acceptance of your offer, at which point a binding contract of sale is formed (subject to Section 4.2 below). We reserve the right to decline or cancel orders prior to dispatch/delivery in case of pricing errors, stock issues, or suspicion of fraud, in which case you will be notified, and any payment received will be refunded.

4.2 Pricing, Taxes, and Currency:

All prices for products are listed in Indian Rupees (INR) by default. Taxes (such as GST) are included in the price unless stated otherwise. Any additional charges (e.g. shipping fees) will be disclosed before you confirm an order. We strive to ensure accurate pricing; however, in the rare event of a typographical error or technical glitch leading to incorrect price display, we reserve the right to cancel the order (with full refund) or contact you for instructions before processing. International customers: If we accept orders outside India, you are responsible for any applicable customs duties or import taxes, as well as currency conversion fees from your bank (if any).

4.3 Third-Party Platforms (Amazon and Others):

Some physical products offered by The Cosmic Connect may be fulfilled through third-party e-commerce platforms such as Amazon (for example, we might list certain crystals or tools on Amazon for your convenience). In such cases, the actual purchase transaction and order fulfillment may be governed by the third-party platform’s terms and policies in addition to our Terms. For instance, if you are redirected to Amazon to complete a purchase, you will be subject to Amazon’s Conditions of Use and return/refund policies for that order. The Cosmic Connect does not own or control such platforms and disclaims liability for any issues arising from their systems (though we will reasonably assist you if possible in resolving any problem). Please review the third-party’s terms and privacy policies when transacting through them. Regardless of platform, we uphold our commitment to product authenticity and quality as described herein.

 

4.4 Digital Products Delivery:

For digital products (such as e-books, meditation audios, online course content, etc.), delivery is typically by providing you a download link or online access after purchase. You agree that once a digital product is delivered or accessed, you will not be entitled to cancel or “return” it for a refund, due to its intangible nature (see the Cancellation/Refunds section for details). Please ensure your device meets any minimum requirements (file format, software) to use the digital content. If you experience any technical issues accessing a digital product you purchased, contact us for support within 48 hours.

5. Booking of Services and Appointments

5.1 Service Booking Process:

We offer both online and offline appointments for services like Tarot readings, Reiki healing sessions, Akashic Records readings, Past Life Regression therapy, etc. You can book a service through our website’s scheduling system or by contacting us via the provided phone or email. When booking, you may need to select a date/time from our available slots and pay any required fee or deposit to confirm the appointment. Once your booking is confirmed (you will typically receive a confirmation email or message), please note the following:

  • Online Sessions: For remote sessions (video/phone), we will provide instructions or a meeting link prior to the scheduled time. You are responsible for having a stable internet connection and the necessary equipment. We are not liable for any inability to deliver the service due to technical issues on your side (though we may attempt to reschedule in such cases at our discretion).

  • Offline Sessions: For in-person sessions at our centre (address provided in the Contact section) or an event venue, you are responsible for arriving on time at the designated location. Please plan accordingly. If you have any condition that could affect an in-person session (e.g. mobility issues), inform us in advance so we can attempt to accommodate.

5.2 Client Cooperation:

To get the best results from our services, you may be asked to provide certain information or take preparatory steps. For example, for astrology-based readings or Akashic sessions, we may request your birth details, and for healing sessions, we might give pre-session guidelines (like avoiding heavy meals or alcohol before a Reiki session). You agree to provide complete and accurate information relevant to the service and to follow any reasonable instructions from our practitioners. Your engagement and openness can influence your experience (especially for energy healing), and you acknowledge that results may vary among individuals.

 

5.3 Punctuality and Changes:

Please be punctual for your session. If you anticipate being late or need to reschedule, inform us as soon as possible. If you are more than 10–15 minutes late without prior notice, we may deem you a “no-show” and the session may be shortened or cancelled with applicable fees (see Cancellation Policy). Likewise, last-minute requests from you to reschedule may be treated as a cancellation. We will do our best to accommodate minor schedule changes, but this may not always be possible due to other bookings.

5.4 Practitioner Availability:

Our services are provided by experienced practitioners (e.g. certified Reiki Masters, Tarot readers, etc.), and we strive to honour every confirmed booking. However, The Cosmic Connect reserves the right to reschedule or cancel a service appointment in cases of practitioner unavailability, illness, emergencies, or other circumstances beyond our control. In such an event, we will notify you as soon as possible and offer either a full refund of any fee paid or an option to reschedule for a mutually convenient time. We will not impose any cancellation charges on you if we initiate the cancellation, and in some cases may provide a discount code or complimentary extension as a goodwill gesture for the inconvenience.

 

6. Pricing and Payment Terms

6.1 Payment Methods:

We accept various payment methods for purchases and bookings, such as credit/debit cards, UPI, net banking, digital wallets, or third-party payment gateways (e.g. Razorpay, PayPal, etc., as available). Payments are processed through secure, PCI-DSS compliant gateways. We do not store your card or banking details on our servers; all sensitive payment information is handled by the payment provider. By providing your payment information, you authorise us (and our designated payment processor) to charge the specified amount to your chosen payment method.

  • For services/appointments, payment is typically required in full at the time of booking to confirm your slot. For certain high-value services or events, we may allow a partial deposit with balance due before the service; such terms will be communicated if applicable.

  • For product orders, full payment (including shipping, if any) is required at checkout. We will charge you using the payment method you provided upon order confirmation. If an order cannot be fulfilled, we will issue a refund as described in Section 4.1.

6.2 Payment Plans:

We might offer instalment plans or subscriptions for some expensive courses or long-term programs. If you opt for a payment plan, you agree to pay each installment on time as per the schedule provided in the plan agreement. Failure to pay an instalment by the due date may result in suspension of access to the course or service, and eventual cancellation of your enrollment with no refund (if payments already made are insufficient to cover the value of services received). We will make reasonable attempts to remind you of upcoming payments. Late or missed payments may also incur interest or late fees if outlined in the specific plan terms (we will disclose any such fees upfront).

 

6.3 Pricing Changes:

Prices of products and services are subject to change. We reserve the right to modify our prices at any time. However, no price change will affect you for an order or booking that has already been confirmed and paid — those will be honored at the price charged. If you have a subscription, see Section 7 for how price changes may affect you. We may offer promotional discounts or referral codes occasionally; these are subject to the terms of each promotion and can’t be retroactively applied.


6.4 Currency and International Transactions:

All transactions on our site are processed in INR unless explicitly stated otherwise. If you are paying from outside India, your bank or card issuer will convert the charge to your local currency at their exchange rate, and they may charge conversion fees. We are not responsible for any differences caused by currency exchange or fees imposed by your payment provider. Ensure your payment method is authorized for international transactions if you are an international user.


7. Shipping and Delivery (Physical Products)

This section applies to orders of physical goods (e.g. crystals, jewellery, tools) purchased through our site or as directed by us.

  • Delivery Areas: We currently deliver products throughout India. International shipping may be available for certain items – availability and shipping fees for international orders will be shown at checkout or communicated before confirming the order. We comply with all legal requirements for shipping products (including displaying country of origin of goods as required).

  • Shipping Method & Time: Orders are typically dispatched within 1–3 business days of order confirmation (unless otherwise specified for a pre-order or custom item). We use reputable courier services or India Post for delivery. Standard delivery times within India are 3–7 business days after dispatch, depending on your location. Delays might occur during holidays, lockdowns, or unexpected logistical issues. We will provide you a tracking number by email/SMS when your order ships, if available.

  • Shipping Charges: Any shipping and handling charges will be indicated at the time of purchase. We may offer free shipping for orders over a certain value or as part of promotions – such conditions will be advertised. International shipments might incur higher postage and possibly customs duties – these are generally to be borne by the customer/recipient. If any additional charges are applicable on delivery (e.g. COD fee, import duty), we will either collect them during checkout or clearly inform you.

  • Receipt of Goods: Please ensure someone is available to receive the package at the address provided. Upon delivery, inspect the package for any visible damage. If you receive a damaged parcel or item, notify us within 48 hours with unpacking video & photos so that we can assist with a resolution (see Returns/Refunds below). Risk of loss or damage to products passes to you once delivered to your address (or upon handover to courier for international shipments outside India).

  • Third-Party Fulfilment: If your product order was fulfilled by a third-party seller or platform (such as Amazon) at our direction, that third party’s shipping policies may apply. For example, Amazon may handle the logistics and provide its own tracking and customer service for delivery issues. We will assist in coordinating with the third party if any problems arise, but note that such orders may be subject to the platform’s processes. We disclaim liability for delivery issues caused by third-party carriers or platforms beyond our control. Still, we will use our best efforts to help you get the product or a refund as appropriate.

  • Non-Delivery and Address Issues: If a package is returned to us due to incorrect address provided by you or failure to collect the package, we will reach out to you. We may request additional shipping charges to resend the item. If we cannot deliver a product due to our fault or courier loss, we will either resend the item at no extra cost or issue you a full refund, per your choice.

8. Cancellation and Refund Policy

We want you to have a satisfying experience with The Cosmic Connect. However, due to the nature of our offerings (many of which are personalised services or digital goods), we have specific policies on cancellations and refunds. This section outlines how cancellations, returns, and refunds are handled for different offerings:

8.1 Cancellation by User – Services/Appointments:

If you need to cancel or reschedule a booked service (Reiki session, reading, etc.), please provide as much notice as possible. Our policy: a minimum of 24 hours notice before the scheduled start time is required for a cancellation or change without penalty.

  • If you cancel or request a reschedule more than 24 hours in advance, we will either refund the session fee in full (minus any nominal payment gateway charges that are non-recoverable, if applicable) or apply your payment to a rescheduled booking, per your preference.

  • If you cancel within 24 hours of the appointment or fail to show up, we reserve the right to charge a late cancellation fee up to 100% of the service fee (meaning you may not receive any refund). This is because our practitioners set aside time for you and may not be able to fill the slot on short notice. We will evaluate emergencies or unforeseen circumstances in good faith. If you missed an appointment due to a true emergency, please let us know, and we may offer to reschedule at our discretion.

  • In compliance with the Consumer Protection (E-Commerce) Rules 2020, we do not impose any cancellation charge on you for service cancellations unless we also incur a similar charge or loss when we cancel in similar circumstances. In other words, we strive for fairness: we will not charge you a penalty for cancelling a service booking unless we are also subject to a penalty if we cancel on you.

8.2 Cancellation by Company – Services:

If we must cancel a service appointment (e.g., due to practitioner illness or an unforeseen issue on our side), you are entitled to a full refund of any amount paid or a rescheduled appointment at no extra cost if you prefer. We will not charge you any fees in such cases. Additionally, if we cancel on very short notice (less than 24 hours before the session), we will make our best efforts to compensate for the inconvenience, such as offering a small discount on a future service or an extended session when rescheduled, in line with the principle of parity in cancellation charges.

8.3 Refunds for Services:

Except as expressly provided in this section, fees for completed services are non-refundable. If you participated in a session or service, the fee covers the time and expertise given, regardless of the subjective outcome of the session. We do not guarantee specific results (see Disclaimers), therefore dissatisfaction with the outcome of a tarot reading or healing session is not grounds for a refund. However, if you believe a service was not delivered as described or had a serious issue, please contact us – we value client satisfaction and may provide a remedy or credit in our discretion in exceptional cases (e.g., if a technical failure on our side cut a paid online session short, etc.).

8.4 Returns and Refunds – Physical Products:

For tangible goods purchased from The Cosmic Connect, we offer a fair return policy in accordance with Indian consumer law.

  • If you receive a defective, damaged, or incorrect product, notify us within 48 hours of delivery with details of the issue (and unpacking video & photos). We will arrange for a return or exchange. Depending on the situation, we may either send a replacement product or provide a full refund (including any shipping fee you paid) at our discretion. We will bear the return shipping cost for confirmed cases of defect/damage or wrong item delivered.

  • If you wish to return a product for other reasons (e.g., if you changed your mind or are unsatisfied), our ability to accept the return may be limited. We generally do not accept returns for “change of mind” on items like crystals or jewellery, due to their personal nature and the risk of handling damage. However, if the product is unused and in original condition, contact us within 7 days of delivery, and we will evaluate on a case-by-case basis. A restocking fee may apply for discretionary returns, and you would be responsible for return shipping.

  • Conditions for Returns: Any return must be in its original condition and include all tags, packaging, and accessories. Items that show signs of wear or have been altered or damaged after delivery will not be eligible for a refund or exchange (unless they had a manufacturing defect reported immediately upon arrival).

  • Process: To initiate a return, email us at info@thecosmicconnect.com with your order details and reason for return. We will provide instructions for return shipping if applicable. Refunds (or replacements) are processed after we receive the returned item and inspect it. Refunds are usually credited to the original payment method within 7-10 working days after approval.

  • Third-Party Purchases: If your purchase was made via Amazon or another platform, the return/refund will typically be handled through that platform’s system. Please follow the instructions on Amazon’s order page for returns. You may also inform us of the issue; we can help facilitate communication with the platform/seller. We will ensure that you are not left without remedy if you are entitled to a return/refund under the platform’s or our policies.

8.5 Refunds – Digital Products:

All sales of digital downloads or online content are generally final. Once digital content has been accessed or delivered to you, it cannot be “returned.” We do not offer refunds for digital products except in these cases: (a) technical issues prevent you from accessing the content and we are unable to resolve it, or (b) an incorrect digital product was delivered (for example, you received the wrong file). In such cases, we will replace the file or, if unable, refund your purchase. If you accidentally purchase multiple copies of the same digital item, contact us for resolution. We encourage you to review product information and system requirements before making a purchase to ensure you order the correct item.

 

8.6 Course Cancellations and Refunds:

Enrolment in our educational courses (whether online or in-person) is a special category:

  • Cancellation by You (Before Course Start): If you decide to cancel your enrollment, you must request this in writing (email is acceptable) at least 48 hours before the course start date. We will issue a refund in this case, but note that an administrative fee of INR 500 (or a percentage of the course fee, as specified in the course terms) will be deducted to cover registration processing costs. If you cancel less than 48 hours before the course begins, or fail to attend, no refund will be given, since your seat and materials have been allocated.

  • No Refund After Commencement: Once a course has started (or access to online course content has been granted), refunds are not provided for any reason. This includes if you drop out midway or are unable to complete the course. However, under extraordinary circumstances (e.g., medical emergency), we may offer partial credit or transfer to a future session, solely at our discretion.

  • Course Cancellation by Us: We reserve the right to cancel or reschedule a course if necessary (for example, if minimum enrolment is not met, or the instructor becomes unavailable). If we cancel a course entirely, you are entitled to a full refund of any fees paid for that course. If we reschedule, your enrolment will be moved to the new dates; if you cannot attend the new schedule, you may request a refund. We will not levy any penalty on you for a course we cancel or change and will notify you as early as possible.

  • Course Transfers: We may allow you to transfer your enrolment to a different course date or a different course of equal value, subject to availability and our approval. Transfer requests should be made as early as possible (preferably more than 48 hours before course start). We are not obliged to grant transfers but will attempt to accommodate reasonable requests one time as a courtesy.

  • Note: Detailed course terms (like prerequisites, technology needed, etc.) will be provided in the course description or enrolment agreement. Those are incorporated by reference into these Terms.

 

8.7 Subscription Cancellation and Refunds:

For subscription or membership plans, the following terms apply:

  • Free Trials: If a subscription plan begins with a free trial period, you will not be billed during the trial. To avoid being charged, you must cancel before the trial ends. If you do not cancel, the paid subscription term will start, and your provided payment method will be charged automatically at the end of the trial.

  • Billing Cycle: Subscriptions renew automatically on their cycle (e.g., monthly or annually) on the calendar day corresponding to your initial sign-up. By subscribing, you authorise us to charge the recurring subscription fee to your saved payment method at each renewal. If you wish to cancel, you must do so before the next billing date to avoid further charges.

  • Cancellation: You may cancel your membership at any time via your account settings or by contacting customer support. If you cancel an ongoing subscription, you will continue to have access to the subscribed services until the end of the current billing period already paid for. We do not provide pro-rated refunds for the remainder of the period after cancellation; your cancellation will take effect from the next billing cycle.

  • Refunds: Generally, fees paid for subscriptions are non-refundable except where required by law. For example, if you were accidentally charged after you timely cancelled, or there was a technical error, we will investigate and issue a refund if appropriate. In cases of proven fraud or account compromise leading to an unauthorised charge, we will, of course, refund unauthorised charges. We also reserve the right to consider refund requests in extenuating circumstances on a case-by-case basis.

  • Termination by Us: If we terminate your subscription or membership due to a breach of these Terms or misuse on your part, you will not be entitled to any refund of the remaining period. If we terminate or discontinue a subscription program entirely for all users (for example, we shut down a membership service), we will provide a pro-rata refund for the remaining period to affected subscribers or offer equivalent value through other services.

  • Changes to Subscription Terms: If the price or features of your subscription plan change, we will notify you at least 30 days in advance. If you do not agree to the new terms, you may cancel before the changes take effect. Continuing the subscription after the change constitutes acceptance of the new terms.

 

9. Courses and Intellectual Property Usage Rights

All content provided through our courses, website, and services is intellectual property owned by The Cosmic Connect (Cosmic Connect India LLP) or our licensors, and is protected by copyright, trademark, and other applicable intellectual property laws. This includes (but is not limited to) course materials, manuals, videos, audios, written readings or reports, website text and graphics, logos, and branding elements.

 

9.1 Ownership and License:

When you purchase a course or access our content, you are not buying the intellectual property itself – you are receiving a personal, non-transferable, limited license to access and use the content for your own personal development and learning. Specifically:

  • You may download, save, and print course materials or resources we provide to you for your personal use only.

  • You may not copy, reproduce, distribute, or publicly display any of our content (in whole or part) to anyone else without prior written permission from us. This means you cannot share your course login with others, upload our videos to YouTube, copy our course text into a public forum, or use our content for commercial purposes (such as running your own course) without authorisation.

  • No Derivative Works: You may not modify or create derivative works based on our content. For example, you cannot translate our course manual and sell it as your own course. You also cannot remove any copyright or watermark notices from materials we provide.

  • Limited Classroom Use: If you are an educator or wish to use some of our content to teach others, you must contact us and obtain a separate license. Our default course purchase does not grant rights to teach our curriculum to others.

 

9.2 Course Certification and Usage:

Upon successful completion of certain courses (like Reiki levels or Tarot reading), we may issue you a certificate of completion. That certificate signifies that you have undergone training with us; it may allow you to practice the learned skills personally or professionally (as per the nature of that field, noting that fields like Reiki or Tarot are generally not government-regulated in India). However, our certification does not license you to perform any activity that is otherwise regulated by law, nor does it make you a “partner” or “agent” of The Cosmic Connect. You should truthfully represent your qualifications to clients—e.g., you can say “certified by The Cosmic Connect in [modality]”, but you must not claim to be an official representative of or healer with The Cosmic Connect unless we have a separate agreement.

All logos, brand names (“The Cosmic Connect”, etc.), slogans, and trademarks displayed on our site or materials are the property of The Cosmic Connect (Cosmic Connect India LLP) unless otherwise noted. You are not permitted to use our trademarks in any manner (such as in advertising your own services) without our prior consent.

9.3 User-Provided Content:

In some cases, we may allow users to post content (for example, comments on blogs, testimonials, or participation in community forums if part of a membership). By submitting any content to our website or to us (text, images, reviews, etc.), you grant TCC a worldwide, royalty-free, perpetual license to use, reproduce, modify, and publish that content for the purpose of operating and promoting our services. You retain ownership of your content, of course, and we will respect your privacy as described in our Privacy Policy. Do not provide any content that infringes others’ rights or is unlawful/abusive (see User Conduct above). 11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Cosmic Connect (Cosmic Connect India LLP) or its owners, partners, employees, associates, practitioners, or agents be liable for any losses or damages of any kind arising out of or related to your use of our website, products, or services. This includes, without limitation:

  • No Indirect Liability: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages – such as loss of data, loss of income, loss of goodwill, emotional distress, or any other intangible losses – arising from or related to (a) the use or inability to use our website or services; (b) any act or omission by us in performing our services; (c) any goods or services obtained through our site; or (d) unauthorized access to or alteration of your transmissions or data.

  • Cap on Direct Damages: If, notwithstanding the other provisions of these Terms, we are found to be liable to you for any damage or loss arising out of or connected with your use of our services or products, our total cumulative liability shall in no event exceed the total amount of fees you have paid to us for the specific product or service that gave rise to the claim (or INR 5,000, whichever is lower). If you have not paid any amount to us (for example, browsing free content on the site), our liability will be zero. This limitation applies to all claims of every kind, whether based in contract, tort (including negligence), strict liability, or any other legal theory.

  • Third-Party Liability: The Cosmic Connect will not be liable for any acts, omissions, or errors of any third parties, including third-party payment processors, e-commerce platforms, couriers, or external websites we may link to. For instance, if a payment gateway fails in processing or a courier loses a parcel, we will assist in resolving the issue but are not financially liable beyond facilitating any remedy from that third party.   • No Liability for Personal Injuries: Our liability for any personal injury or property damage arising from attending an in-person session or using a product will be limited to the fullest extent permitted by law. We take reasonable measures for safety, but we expect you to also take care. If you have a condition (like epilepsy, allergies, etc.) that could be affected by our service (flashing lights in a meditation, scented incense, etc.), you must inform us or take appropriate caution. We will not be liable for harm you sustain due to failing to disclose pertinent information or not following guidance. Nothing in these Terms, however, excludes liability for death or bodily injury caused by our gross negligence or willful misconduct, or any other liability which cannot be excluded under law.

  • Your Actions: We are not liable for any damage caused by your own actions or decisions. If you decide to, for example, quit your job, break up a relationship, stop a medication, or take any significant step in reliance on something gleaned from a Tarot reading or spiritual advice from us, that decision is solely your responsibility. You cannot hold us responsible for the consequences of your life choices.

 

Indemnity: You agree to indemnify, defend, and hold harmless The Cosmic Connect (Cosmic Connect India LLP) and its affiliates and personnel from and against any and all claims, liabilities, losses, damages, expenses, or demands (including reasonable legal fees) arising out of or related to (a) your use or misuse of our products or services, (b) your breach of these Terms, or (c) your violation of any law or rights of a third party. This means if a third party sues us because of something you did in violation of these Terms (for example, you shared course content illegally or you caused damage at an event), you will cover all costs and damages we incur. We will promptly notify you of any such claim and may assist in your defence (at your expense), but we reserve the right to assume exclusive defence control if necessary.

13. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, in particular respecting consumer rights and e-commerce regulations. This includes (but is not limited to) adherence to the Information Technology Act, 2000 (and its amendments) and the Consumer Protection Act, 2019, as well as the Consumer Protection (E-Commerce) Rules, 2020, and any applicable data protection laws of India. For example, under Section 10A of the IT Act, contracts formed through electronic means (like your acceptance of these Terms online) are legally valid and enforceable. Nothing in these Terms is intended to limit your rights as a consumer under Indian law; in the event of a conflict, mandatory provisions of Indian consumer law will prevail.

 

13.1 Jurisdiction:

You agree that any disputes or claims arising out of or relating to these Terms, or your use of our services or products, shall be subject to the exclusive jurisdiction of the courts located in New Delhi, National Capital Territory of Delhi, India. If you are a consumer residing outside Delhi in India, you may also have the option to file suit in your home jurisdiction as per applicable consumer laws, but you agree not to object to New Delhi courts’ jurisdiction if we choose that venue. (This choice of jurisdiction is made to provide a predictable legal forum for both parties.)

 

13.2 Dispute Resolution Process:

We genuinely hope to resolve any concern or dispute amicably. Before taking any legal action, please contact us (via the Grievance Officer or support email) to explain the issue. We commit to listening and trying in good faith to resolve the matter directly. Often, a simple conversation can resolve misunderstandings. If we are unable to resolve the dispute within 30 days of your raising it, either party may then proceed to seek legal remedy.

As per the Consumer Protection Act, you also have the option of seeking redressal through consumer courts or online consumer mediation cells for consumer disputes. These Terms do not restrict you from accessing such statutory remedies.

 

13.3 Arbitration (Optional):

For any disputes that cannot be resolved through negotiation, we may mutually consider arbitration as an alternative. If both you and The Cosmic Connect agree in writing, we can refer the dispute to binding arbitration in New Delhi in accordance with the Arbitration and Conciliation Act, 1996. The arbitration would be conducted in English by a single arbitrator appointed by mutual consent. Each party would bear its own costs, and the arbitrator’s award can be entered in any court of competent jurisdiction. This is optional and requires mutual agreement; it’s not mandatory via these Terms alone.

 

13.4 Governing Law:

The interpretation of these Terms and any issues arising between us shall be governed by the laws of India. This means, for example, if there’s a question about how to interpret a clause in these Terms, or whether something is a breach, we will look to Indian contract law and related statutes for guidance. If any lawsuit or legal proceeding does occur, it will be conducted in accordance with Indian procedural and substantive law.

14. Modifications to Terms

The Cosmic Connect reserves the right to change or update these Terms & Conditions at any time. We may modify or remove existing sections, or add new sections, in response to changes in our services, laws, or for any other legitimate purpose. If we make material changes, we will notify users by posting the updated Terms on our website with a new “Last Updated” date, and/or by other means (for example, via email notification if you have an account with us, or a notice on our homepage).

Continued use of our website or services after an update constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the site and services and (if you have an account) optionally notify us to deactivate your account. We encourage you to review the Terms periodically for any updates.

For any clarification on a change, you can contact us. No modification to these Terms by any party other than TCC will be binding unless expressly agreed in writing and signed by an authorized representative of The Cosmic Connect.

15. Miscellaneous Provisions

  • Entire Agreement: These Terms, along with any additional policies or guidelines referenced (such as our Privacy Policy, and any specific terms for certain services or courses), constitute the entire agreement between you and The Cosmic Connect regarding your use of our site and services, and supersede any prior agreements or understandings (whether oral or written) relating to the same subject matter.

  • Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be deemed severed from the Terms, and the remaining provisions shall continue in full force and effect. We will endeavor to replace an invalid provision with a valid one that comes closest to the intention of the original.

  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be explicit and in writing to be effective. If we waive a breach by you, it does not mean we waive any future breach by you or anyone else.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law, and will use reasonable efforts to notify you.

  • Relationship: Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and The Cosmic Connect. You are using our services as an independent individual. You cannot represent yourself as our agent or representative for any purpose.

  • Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.

  • Force Majeure: We will not be liable for any delay or failure in performance of any part of the service (including delivering products or scheduling sessions) to the extent such delay or failure is caused by events beyond our reasonable control, such as acts of God, war, strikes, epidemics, internet outages, or government restrictions.

  • Grievance Redressal: As required by Indian law, we have appointed a Grievance Officer to address user grievances. Please see the Contact section below for details. We follow the timelines mandated under the Consumer Protection (E-Commerce) Rules for grievance resolution (acknowledgement within 48 hours, resolution within 1 month).
